PROPOSITION 65
California Proposition 65 — officially the “Safe Drinking Water and Toxic Enforcement Act of 1986”, also known as Proposition 65 — is a law that requires businesses to provide warnings to California consumers regarding the sale of products found to contain any one of nearly 900 chemicals on the Proposition 65 list — a list which is administered and updated annually by the OEHHA — California’s Office of Environmental Health Hazard Assessment, part of the California Environmental Protection Agency. The warning does not mean that a product will actually cause any harm. Moreover, a Proposition 65 warning does not mean a product is in violation of any product-safety standards or requirements. In fact, the California government has clarified that “the fact that a product bears a Proposition 65 warning does not mean by itself that the product is unsafe.” The government has also explained, “You could think of Proposition 65 more as a ‘right to know’ law than a pure product safety law.” (oehha.ca.gov/prop65/background/p65plain).
While Proposition 65 is a broad, controversial law that applies to any company operating in California, and selling products in California — and our company (as an authorized dealer of some of the most respected industry brands) specializes in the rental, retail sale, and application of professional audio equipment (not the manufacture or marketing of our own consumer products) — out of an abundance of caution, and in order to ensure compliance and avoid the potential for liability, we include the relevant Proposition 65 notice both at our business site, on our website, and on our online shopping website. It is possible that some of the substances on the Prop 65 list may be present in our inventory of products, so, we present the warning for our customers in order to comply with this California ‘right to know’ law and to fall within a safe harbor provided under Proposition 65.
